Some years back we wrote about the tragic shooting in San Bernardino. Unfortunately gun violence has been on the rise. We have been asked what legal rights victims and loved ones might have. Trauma caused by mass shootings should receive protection under the Family Medical Leave Act/CFRA [CLICK THROUGH TO THAT PAGE] for eligible employees. If not there are California Labor Codes that allow victims of violence time off. Another avenue might be California Labor Code Section 233 which provides job protections against terminations due to sickness if a certain amount of sick time is banked. Victims of sudden, unexpected events at work may be able to file a work stres case. Store robberies used to be the example.
